{"id":45642,"date":"2024-03-27T17:59:28","date_gmt":"2024-03-27T20:59:28","guid":{"rendered":"https:\/\/scpa.org.br\/?p=45642"},"modified":"2024-03-27T17:59:30","modified_gmt":"2024-03-27T20:59:30","slug":"decreto-57-514-2024","status":"publish","type":"post","link":"http:\/\/mail.scpa.org.br\/index.php\/2024\/03\/27\/decreto-57-514-2024\/","title":{"rendered":"Decreto 57.514\/2024"},"content":{"rendered":"\n<p><strong><span style=\"text-decoration: underline;\">MODIFICA\u00c7\u00c3O NO REGULAMENTO DO ICMS (RICMS)<\/span><\/strong><\/p>\n\n\n\n<p>Implementa\u00e7\u00e3o de Ajustes SINIEF a seguir relacionados, aprovados pelo Conselho Nacional de Pol\u00edtica Fazend\u00e1ria &#8211; CONFAZ, na legisla\u00e7\u00e3o estadual.<\/p>\n\n\n\n<p><strong>Art. 1\u00ba:<\/strong><\/p>\n\n\n\n<p><strong>Alt. 6289 &#8211;<\/strong> Ajuste SINIEF 07\/05 e 43\/23 &#8211; Revoga a denega\u00e7\u00e3o da autoriza\u00e7\u00e3o de uso e estabelece como hip\u00f3tese de rejei\u00e7\u00e3o do arquivo da NF-e a situa\u00e7\u00e3o irregular do contribuinte, quando a inscri\u00e7\u00e3o no CGC\/TE do emitente ou do destinat\u00e1rio estiver cancelada, baixada de of\u00edcio ou suspensa. (Lv. II, art. 26-A, nota 02)<\/p>\n\n\n\n<p><strong>Art. 2\u00ba:<\/strong><\/p>\n\n\n\n<p><strong>Alt. 6290 &#8211; <\/strong>Ajuste SINIEF 09\/07, 31\/22 e 46\/23 &#8211; Revoga a denega\u00e7\u00e3o da autoriza\u00e7\u00e3o de uso e estabelece como hip\u00f3tese de rejei\u00e7\u00e3o do arquivo do CT-e a situa\u00e7\u00e3o irregular do emitente, quando sua inscri\u00e7\u00e3o no CGC\/TE estiver cancelada, baixada de of\u00edcio ou suspensa e prev\u00ea a emiss\u00e3o de CT-e Simplificado em presta\u00e7\u00f5es de servi\u00e7os de transporte, para um \u00fanico tomador de servi\u00e7o, envolvendo mais de um emitente ou destinat\u00e1rio. (Lv. II, art. 108-A, nota 05 a 07)<\/p>\n\n\n\n<p><strong>Art. 3\u00ba:<\/strong><\/p>\n\n\n\n<p><strong>Alt. 6291 &#8211; <\/strong>Ajuste SINIEF 21\/10 e 45\/23 &#8211; Estabelece o momento em que o MDF-e deve ser emitido e encerrado. II, art. 108-D, &#8220;caput&#8221; e nota 06)<\/p>\n\n\n\n<p><strong>Art. 4\u00ba:<\/strong><\/p>\n\n\n\n<p><strong>Alt. 6292 &#8211;<\/strong> Ajuste SINIEF 19\/16 e 10\/23 &#8211; Revoga a denega\u00e7\u00e3o da autoriza\u00e7\u00e3o de uso e estabelece como hip\u00f3tese de rejei\u00e7\u00e3o do arquivo da NFC-e a situa\u00e7\u00e3o irregular do emitente, quando sua inscri\u00e7\u00e3o no CGC\/TE estiver cancelada, baixada de of\u00edcio ou suspensa. (Lv. II, art. 26-C, nota 03)<\/p>\n\n\n\n<p><strong>Art. 5\u00ba:<\/strong><\/p>\n\n\n\n<p><strong>Alt. 6293 &#8211; <\/strong>Ajuste SINIEF 36\/19 e 09\/23 &#8211; Revoga a denega\u00e7\u00e3o da autoriza\u00e7\u00e3o de uso e estabelece como hip\u00f3tese de rejei\u00e7\u00e3o do arquivo do CT-e OS a situa\u00e7\u00e3o irregular do emitente, quando sua inscri\u00e7\u00e3o no CGC\/TE estiver cancelada, baixada de of\u00edcio ou suspensa. (Lv. II, art. 132-A, nota 05)<\/p>\n\n\n\n<p><strong>Art. 6\u00ba:<\/strong><\/p>\n\n\n\n<p><strong>Alt. 6294 &#8211;<\/strong> Promove ajuste nas refer\u00eancias \u00e0 denega\u00e7\u00e3o da autoriza\u00e7\u00e3o de uso, revogada, substituindo por rejei\u00e7\u00e3o dos arquivos dos documentos fiscais.
